These terms cover the AirWar game and https://airwar.games. They set out the rules for using the game and the website and the conditions of optional purchases in the game.
1. Publisher and scope
The publisher of the game, the seller of its digital content and the provider of the website is SAMSUFI SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, address: ul. Jagiellońska 4A, 19-120 Knyszyn, Poland, entered in the register of entrepreneurs of the Polish National Court Register (KRS) under number 0000901262, EU VAT: PL5423435334, referred to as “we” or “the publisher”.
For the game, purchases and complaints, contact [email protected]. For personal data matters, contact [email protected]. We do not run a telephone helpline; email is our contact channel. These details are available before you conclude a contract: in these terms, on airwar.games and through the links in the game's Settings.
The first release is for Android and is distributed through Google Play as pl.samsufi.airwar. An iOS version is planned and does not yet exist. References to iOS describe planned arrangements and will apply only once that version is available.
In the planned iOS version, Apple Game Center will handle achievements and leaderboards, a private iCloud container will hold saved progress, and purchases will be made through Apple In-App Purchase. Neither progress nor purchases will transfer from Android to iOS or from iOS to Android. Before the iOS version is released, we will update these terms with any iOS-specific details.
2. The game, website and requirements
AirWar is a single-player game about biplane duels against eight computer-controlled opponents. It includes a star-based campaign, training, achievements and leaderboards. It does not offer multiplayer, chat, publisher-operated user accounts, forms or user-generated content. The website presents the game and links to the stores and Godot Engine.
The game and website have 17 language versions, including Polish and English. The legal documents are available in Polish and English.
The game requires a device running Android 7.0 (API level 24) or newer and is played in landscape orientation. To use the website, you need a web browser. Gameplay works without an internet connection. Downloading the game, displaying ads, making and restoring purchases, and Google Play Games features require an internet connection. Any connection charges are governed by your agreement with your network provider.
These terms are available free of charge before a contract is concluded, in a form that you can save and reproduce: on airwar.games, in the store listing and in the game's Settings.
The contract for use of the game is concluded when you tap “Continue” on a one-time screen shown when you first launch the game, before the advertising consent form. That screen links to these terms and the Privacy Policy. Accepting these terms is separate from advertising consent and does not imply any consent to ads, tracking or personalisation; you make those choices separately in the consent form.
You can stop using the website by closing it, and stop using the game by closing or uninstalling it. Uninstalling does not cancel a subscription.
3. User age
The game is intended for people aged 13 and over. It is not directed at children under that age and does not participate in the Google Play Families programme.
The game does not ask users for their age. Identifying the intended audience as 13+ does not verify age or constitute consent to personalised advertising.
If you do not have full legal capacity to enter into contracts, use the game and make purchases with a parent’s or guardian’s permission where the law applicable to your situation requires it. Turning 13 does not automatically allow you to enter into every contract or give every type of data consent independently. In Poland, the child consent threshold under Article 8 GDPR is 16. Data processing and advertising are explained in the Privacy Policy.
4. Licence and intellectual property
The publisher grants you a non-exclusive licence to download and use the game personally in accordance with these terms and the rules of the store from which you obtain it. Buying a skin or a subscription gives you the right to use the described feature; it does not transfer copyright in the game or its elements.
Rights in the game and the publisher’s materials belong to the publisher. Rights in third-party software, trade marks and other elements remain with their respective right holders. Their separate licences continue to apply.
You must not distribute the game without permission, sell copies or use its elements in breach of intellectual property rights. These restrictions do not cover acts permitted by mandatory law, including legally permitted examination of the program’s operation or decompilation, or acts allowed by the licences of its components. Section 14 also addresses the licence for the future iOS version.
5. Rules of use
- Use the game, website and third-party services lawfully.
- Do not interfere without authorisation with security measures, purchase processing or the operation of services.
- Do not falsify purchases, achievements or scores submitted to leaderboards.
- Do not send unlawful content or malicious software, including in messages to support.
- Do not impersonate someone else or infringe their rights.
These rules do not restrict your ability to exercise statutory consumer rights, report a fault or exercise personal data rights.
6. Ads and free gameplay
The game is free and contains Google AdMob interstitial ads. They may appear after a campaign match, at most every third match, no more often than once every three minutes, and only after the first three minutes of a session. Training matches do not count towards this frequency. There are no banner ads or rewarded ads.
While the “no ads” subscription is active, no interstitial ads are shown. The advertising SDK may still run in the background; the Privacy Policy explains what this means for your data. Paint schemes earned with stars are free. Advertising consent, protections for minors and changing your choice through Settings → “Privacy and ads” are also explained in the Privacy Policy. Accepting these terms is not consent to tracking or personalised advertising.
7. Purchases and prices
Purchases are optional. They are made exclusively through Google Play (Google Play Billing) and, for the planned iOS version, the App Store (Apple In-App Purchase). The publisher does not receive your card details. The game receives information needed to recognise a purchase or active subscription, including the product, status and purchase token.
| Product | What you receive | Billing |
|---|---|---|
| no_ads_monthly | No interstitial ads while the subscription is active | Automatically renewing monthly subscription |
| skin_szachownica | An aircraft skin | A permanent one-time purchase |
| skin_pasy | An aircraft skin | A permanent one-time purchase |
| skin_rekin | An aircraft skin | A permanent one-time purchase |
| skin_moro | An aircraft skin | A permanent one-time purchase |
Price of the subscription and each skin: the price shown in the store before purchase.
Before confirming a purchase, check the exact tax-inclusive price, billing period and product description in the store. The conditions presented for that purchase before confirmation apply. Do not buy if the store screen lacks required information or the price is unclear to you.
A permanently purchased skin does not require further subscription payments. This does not mean that you waive your rights if access is later lost.
Purchases are tied to your store account. The game checks your purchases automatically when it starts and when you return to it, and its Settings contain a “Restore purchases” button, for example for use after reinstalling the game or moving to a new device signed in to the same store account. The last known purchase status is stored on the device so that purchased content also works offline. Purchases are not transferred between Android and iOS. Family sharing is available only if the store offers it for a given product.
The store processes the payment, issues the receipt and handles refunds under its own terms. The store's terms also state who the seller of record is in the buyer's country. Regardless of that, the publisher remains responsible for the conformity of the game's digital content and services with the contract, as described in section 10.
8. Subscription renewal and cancellation
The no_ads_monthly subscription renews automatically every month until cancelled. The store charges further payments according to the terms shown at purchase. You can cancel at any time in the store's subscription settings; cancellation takes effect at the end of the current billing period, preserves access until then and stops charges for future periods. Separate rules apply to statutory withdrawal (section 9) and refunds.
- Android: open Google Play, select your profile, then Payments and subscriptions → Subscriptions → AirWar → Cancel subscription. See Google’s instructions.
- Planned iOS version: open device settings, select your Apple Account and Subscriptions, then the AirWar subscription and the cancellation option. See Apple’s instructions.
Check the next renewal date in the store and cancel renewal before that date. Simply closing the game, clearing its data, withdrawing advertising consent or uninstalling does not turn off renewal.
You may request a refund under the Google Play EEA refund rules or through Apple’s process. Store rules do not remove statutory rights. You can report a problem to us at [email protected]; you do not have to unsuccessfully complete the store’s process before raising a claim against the publisher.
9. Right of withdrawal
A consumer entering into a distance contract generally has 14 days to withdraw without giving a reason. For the content and services described here, this period runs from the conclusion of the contract. The following exceptions apply only if their legal conditions have actually been met. They do not limit complaints about a lack of conformity with the contract.
Skins: digital content supplied in a single act
A paid skin is digital content supplied without a physical medium. It is delivered immediately after purchase. Before you confirm the purchase, the store's purchase flow asks for your express consent to immediate supply and your acknowledgement that you thereby lose the right of withdrawal, and the store then sends you a confirmation of the purchase. Once the skin has been supplied under these conditions, the right of withdrawal does not apply (Article 38(1)(13) of the Polish Consumer Rights Act). Accepting these terms, paying or launching the game alone does not replace those conditions.
If any required condition is missing, we do not rely on that exception. Failure to provide the required information about the withdrawal right may also extend the statutory withdrawal period.
The “no ads” subscription: a digital service
The “no ads” subscription is a digital service supplied continuously. You may withdraw from it within 14 days of concluding the contract. If, in the store's purchase flow, you requested that the service start immediately, it starts at once; if you then withdraw, a charge proportionate to the part already provided is permitted only where the statutory conditions, including information duties, have been met. The right of withdrawal is lost only in the cases provided by law, in particular where the service has been fully performed with your express prior consent and your acknowledgement that you lose the right upon full performance (Article 38(1)(1) of the Polish Consumer Rights Act).
Withdrawal is different from cancellation. You can cancel the subscription at any time in the store's subscription settings, with effect from the end of the current billing period (section 8).
Refunds for store purchases are made through the store. To exercise your statutory rights, you can also contact us at [email protected].
How to withdraw
Send an unambiguous statement to us at [email protected] or use the store's refund process. Identify the product, purchase date and information that allows the transaction to be located. Do not send a card number or password. To meet the deadline, it is sufficient to send your statement before the withdrawal period ends. You do not have to use a specific form.
You may use the following model by completing the indicated details:
I hereby give notice that I withdraw from my contract concerning: product name. Contract date: date. Consumer’s name: details. Consumer’s address: address. Order number, if available: number. Date of notice: date. Consumer’s signature only if this form is submitted on paper.
Where a refund is due, it must be made without undue delay and no later than 14 days after receipt of the withdrawal statement, using the same payment method unless you expressly agree to another method without additional cost. Statutory rules on payment for performance already provided apply. Effective withdrawal may end access to the refunded product.
10. Conformity of the game and purchases
We are responsible for supply and conformity of digital content or services to the extent required by our contract with you and by law. This includes requirements concerning functionality, compatibility, security and updates. Statutory protection may also cover certain contracts without a monetary price where a consumer provides personal data used for purposes other than performing the contract itself or meeting a legal obligation.
Where the Polish Consumer Rights Act applies:
- For a single act or a series of individual acts of supply, we are responsible for a lack of conformity existing at supply that becomes apparent within two years. A lack of conformity appearing within the first year benefits from the statutory presumption that it existed at supply.
- For continuous supply, we are responsible for a lack of conformity occurring or becoming apparent during the period in which the supply is due.
- We provide necessary updates, including security updates, and inform you about them for the period required by law: throughout continuous supply, or for a reasonably expected period in the case of a single act or a series of individual acts of supply.
- You may require the content or service to be brought into conformity free of charge, within a reasonable time and without significant inconvenience. Refusal is permitted only in circumstances provided by law.
- You may request a proportionate price reduction or terminate the contract under the statutory conditions, including where conformity cannot be restored, has not been properly restored, the problem persists despite an attempt to remedy it, or it is serious enough to justify immediate use of these remedies.
- For a paid supply, termination for lack of conformity is not available if the lack of conformity is minor; the trader must prove that it is minor. Refunds due following a price reduction or termination must be made within the statutory period, no later than 14 days after the relevant statement.
If the content or service has not been supplied, you may require supply and exercise the statutory right to terminate, or terminate without an additional request in circumstances provided by law. Detailed rights are set out in Chapter 5b of the Polish Consumer Rights Act, which implements Directive (EU) 2019/770. Consumer protection laws in your country may provide additional rights.
11. Complaints
You may send a complaint about the game, website or the publisher’s supplies to [email protected]. Describe the problem and the remedy you seek and, where helpful, provide your device model, operating system and game version, and order identifier. These details help investigate the matter; we do not require your card details or account password.
We respond to a consumer complaint within 14 days of receiving it, unless a specific applicable legal provision provides otherwise. We provide the response on paper or another durable medium, such as email. Where Article 7a of the Polish Consumer Rights Act applies, failure to respond within the statutory period means the complaint is accepted. This is the response deadline, not a promise to complete every repair within that time.
Store handling of payments does not exclude our liability under law or contract. Claims against the store may also be addressed to it through its relevant support channel.
12. Third-party services, saves and availability
Ads, billing and Google Play Games Services are operated by third parties. Their operation also depends on their systems, your account with the provider and the network connection. The relevant service terms apply. The game also works without a Google Play Games profile.
Progress, settings and statistics are saved locally. Clearing app data or uninstalling removes those local data. Cloud saves and Play Games activity are separate and do not automatically disappear when the game is uninstalled. The Privacy Policy explains data deletion.
We do not promise uninterrupted availability of third-party services. However, their failure or withdrawal does not remove statutory claims concerning features we have agreed to supply. A provider’s changes alone do not automatically release us from liability.
13. Updates, changes and discontinuation
Necessary fixes to maintain conformity are governed by section 10. Changes going beyond that purpose require an appropriate contractual basis and must respect existing rights, including one-time skin purchases and paid subscription periods.
We may change continuously supplied features (such as the “no ads” subscription or the Google Play Games integration) or these terms only for the following reasons:
- changes in the law or in decisions of public authorities;
- changes in the requirements of operating systems or app stores;
- changes in the technical interfaces of providers whose services are necessary for the game to work, such as Google or Apple;
- security reasons.
We will inform you of such a change at least 30 days before it takes effect, in the game or on airwar.games, and also by email if we have your email address. If you do not accept the change, you may terminate the contract, in particular by cancelling the subscription.
Where Articles 43p–43q of the Polish Act apply, a change not required to maintain conformity must not create additional costs. Information must be clear, and if the change has a significant negative effect on access or use, it must be provided sufficiently in advance on a durable medium. The consumer may then terminate without a notice period within 30 days of the change or of later notice of it, unless they can retain the unchanged, conforming supply at no additional cost. This power to make changes does not apply to content or services supplied in a single act.
If we decide to discontinue the game, we will announce it at least 30 days in advance in the game or on airwar.games. Holders of an active subscription retain their statutory rights. Discontinuing the game does not cancel obligations under existing contracts, refunds due or statutory conformity duties. Merely publishing new terms does not retrospectively change purchase conditions or automatically amount to a user’s agreement to change an ongoing contract.
14. Planned iOS version and Apple’s licence
For the game downloaded from the App Store, Apple’s standard Licensed Application End User License Agreement will apply, supplemented by these terms. For a third-party app, the licensor is its publisher. These terms supplement information about AirWar, purchases, complaints and consumer rights; we do not use a custom EULA in place of the standard licence.
Apple remains responsible for its own obligations under store terms and applicable law. The publisher provides help with the operation of AirWar through [email protected]. Neither the licence nor these terms restrict mandatory consumer rights.
15. Liability and governing law
The publisher’s liability is governed by applicable law. These terms do not exclude liability that cannot lawfully be limited, do not cap compensation at the purchase price and do not remove a consumer’s remedies for a lack of conformity.
Polish law governs the contract with the publisher. If you are a consumer, this choice does not deprive you of protection under mandatory provisions of the law that would apply without that choice, in particular the law of your habitual residence. We do not impose the exclusive jurisdiction of Polish courts; jurisdiction is determined by applicable rules.
Consumer protection provisions also apply to people whom the law grants particular consumer rights even though their contract relates to a business activity, to the extent provided by that law.
16. Out-of-court dispute resolution and contact
You may seek help from a consumer ombudsman, relevant alternative dispute resolution bodies and, for cross-border matters, a European Consumer Centre. Information and directories are available from UOKiK and the European Commission.
If a complaint does not resolve the dispute, we will provide the legally required statement on a durable medium about whether we agree to participate in an out-of-court procedure and, where required, information about the competent body. Your right to go to court remains. The former EU ODR platform has closed and is not available for new complaints.
Send questions about these terms and the publisher’s supplies to [email protected], and personal data questions to [email protected].
